I find it hard to understand ,why we would not do whatever we can, to prevent impaired driving. Even just an investigation, 2 hours later, after the fact, may prevent,' next time'.

Well it's all fine until an innocent person goes to jail.
Isn't that a bigger travesty? It basically means the law is broken,
and cannot be relied upon.

Even though the evidence bar is set quite high,this is a really bad law subject to horrendous civil rights violations. The intent to prevent drunk drivers from using the "I didn't have a drink until after the accident" defense is an honest attempt to close that loophole,in this case,the ends clearly don't justify the means.
