Just have to force the Village Idiot to justify why Canada is still in a Federal Health Emergency (State of Emergency) .
There is little threat to public safety now, with 98% of people who get Covid no longer requiring Medical intervention and a robust inoculation program underway.
Emergency measures and emergency management at the federal level in Canada are regulated by the Emergency Act and the Emergency Management Act.
However, there is a relatively high trigger for the federal government to take the lead in a health emergency. Therefore, most health emergencies or crises are dealt with at the municipal and provincial level in coordination with the federal government. Most provinces and territories have passed various “health acts” that govern the powers and duties of health officials during a health emergency.
At the federal level, the Emergencies Act authorizes the government of Canada to take special temporary measures through a declaration of a “public welfare emergency,” which the Act defines as an emergency caused by a real or imminent disease in human beings, animals, or plants (among others) “that results or may result in a danger to life or property, social disruption or a breakdown in the flow of essential goods, services or resources, so serious as to be a national emergency.”[29] However, the federal government’s power to issue a declaration of a public welfare emergency can only be triggered after a relatively high threshold is met.
So the Feds tell the province they have to have lockdowns....once the immanent Health Emergency is over....then the Provinces can lift Lock Down restrictions if they want.

If it is a Charter violation it would be up to the courts to issue an order to "cease and desist." If Trudeau tried it unilaterally the provinces could and probably would tell him to get stuffed.

That is correct...but as long as the Feds have us in a State of health Emergency..they have to. That is why the Cons are trying to get that lifted.
